Availability Only
On occasion we may advise that a particular advertiser may only be able to advertise on an “availability-only basis”.
This means that although the product may be legally sold and advertised, there is no scope for any claims to be made about it. An example might be a particular food supplement for which there are no authorised health claims.
An availability-only ad must contain no kind of effectiveness claim, whether it be made explicitly or implicitly. Such an ad must not direct listeners somewhere where those claims are being made, such as a website, be that through a direct link, or a “search PRODUCT NAME” style call to action.
